Incapability

Sometimes the world moves on, and staff cannot move with it. The job they were employed to do has changed, and they cannot. Or their medical state may be preventing them from continuing to do a job well or at all.

  • No charity can afford passengers. Try to find an acceptable settlement, including redundancy, early retirement or redeployment, with appropriate post-employment support.
  • Ensure that you have proper review procedures that give the employees a chance to put their point of view, and provide for an appeal against any termination of their contract.
  • If the reason for incapability is health-related, seek independent medical advice before proceeding - but the final decision is still yours.
